In this study, looking through both juridical and sociological perspectives, the authors propose implications regarding the design of salary peak system by suggesting its’ direction and the necessity of utilizing those workers under the system.
First, our system was adopted due to the conflict between the requirement of society of maintaining employment status of middle aged people and managerial resistance demanding employment adjustment of those showing relatively low labor productivity compared to their wage. However, whether those workers of fifties do really show low performance is yet controversial, and that even if so, there are many other related factors affecting the low productivity which allows those workers to still be valuable labor force.
Second, the system generally associates with disadvantageous change of employment conditions, thus, when it is to manipulate conditions for the age, we should look at workers’ abilities and the contents of work in detail. Furthermore, considering the purpose of the ‘Act on prohibition of age discrimination in employment and elderly employment promotion’ and its’ article 19-2, it really is in need of reorganizing the wage system for our society. we look for economic development and the complementary optimization of management and labor right simultaneously to attain societal rationality. Therefore, no matter how we put the system in to practice, whether it is by collective agreement or regulation of employment, we should find the plausible way not to deprive employees’ vested right but to enhance social efficacy, considering the purpose of the system for facing low-birth and aging society.
Third, workers as human being, have dignity and value. To support this, employers should act trustfully to help workers realize their personal rights, since they have duty to prevent the workers from getting mental distress for being hindered or thwarted when realizing their rights. Employees, perceiving injustice from the manipulated employment conditions, get to feel distrust and unfairness thus, their identities getting harmed. This shall lead employees to act negatively. For this reason, the manipulation of conditions should be understood based on the realization of human rights and the right to pursue happiness.
These workers have long been in organizations. they are skillful and have much knowledge. Those who get to be under the salary peak system would still work for at least 3 more years there. Thus, employers should think of the way to operate this precious period valuable which would make them benefit competitiveness. Yet, many organizations are still obsessed to immediate personnel expenses and productivity. Based on the discussion of this study, the desirable system of salary peak may settle down in our society when we continue the discussion regarding the establishment of the appropriate way to guarantee both the realization of their ‘self’ and also the utilization of their work force.
