고려율령은 당·송·원의 영향을 받았다. 이 가운데 고려에 미친 송의 영향을 보기 위하여 먼저 『송형통』 호혼문과 『고려사』호혼조의 편찬 체제를 살펴보았고, 전자는 칙령체제로, 후자는 조령체제로 이루어져 있어 체제면에서도 율과 령이 함께 구성되었음을 알 수 있었다.
한편 호혼법을 중심으로 양국의 천인제의 특질을 구명해보았다. 송은 당과 달리 양천제가 변질되어 다양한 고용형태로 노비가 창출되었다. 특히 이 시기에는 양인마저 천인의 공급원이 되었다. 그러나 이들이 고용에 의해 주인에게 귀속되었다고 하더라도 그들은 주인에 전적으로 의지하는 존재이며, 이들에게 천인율이 적용되었다는 점, 그리고 천인뿐만 아니라 고용인도 친족만이 대상이 되었던 犯盜의 감형범주에 포함이 되었다는 점 등에서 노주관계가 형성되었으리라 본다.
이에 대해 고려는 원간섭기부터 노비제정비가 국가주도로 진행되었다. 이러한 개혁은 당시 외적의 침입으로 인한 국가위기국면에서는 가능하였으나 외부적 요인이 사라지면서 정치세력간의 갈등을 야기하였다. 이에 국왕과 개혁유신은 쌍방의 갈등을 해결하기 위하여 민본정치를 지향하였다. 이러한 의미에서 노주관계는 매우 중요하였다. 따라서 국왕과 노주들은 명분론을 정당화하기 위하여 노비를 天民또는 인간으로 보아 이들에게 사회질서 유지를 위한 일정한 역할을 요구하였다. 특히 노비를 보는 이러한 시각은 노비가 국가통치권 내에 있는 존재이며, 한편에는 양인과 같은 인간이라는 것을 부각시켰던 것이다. 이는 더 나아가 노주들은 노비에게 강상의 윤리를 요구하기에 이르게 됨에 따라 노비는 상당히 억압적인 지위에 머물게 되었다.

다국어 초록 (Multilingual Abstract)

KoryoUlryoung was influenced by Tang, Song and Won dynasties. Among these dynasties, the influence of Song was noticed in Ohungjo. Moreover, the compilation system of Songhungtong and Koryosa was consisted of the imperial order in the former and the ordinance in the latter which was consisted of Rul and Ryoung together in the system.
I have searched for the characteristics of Chunin system related to Hohonbeop. In Song dynasty, the Yangcheon system was changed which was resulted in the disappearance of traditional slave and more the appearance of modern system of slave. Especially, Yangin was resulted in the source of supply to slave. Therefore, various possibilities on the relationship of slave and its owner was came up with. However, even if they were reverted to the owners in the name of employment, they were wholly dependent to the owners, and belonged to Chuninyul, and not only chunins but employers were also included in the remission category that formed the relationships of slave and owner.
In this period, Koryo dealt with slave system reorganization from Yuan intervention period. In the doctrine related to slave system, King Chunrul made the restoration of Yangchun System and that was related with the strength of royal authority.
In this sense of relations, the relation between slaves and owners were very important. Therefore in order of justifying this term the king and slave owner insisted of certain roles to maintain social order. Especially slave was the being within the sovereignty and became the same human being as Yangin. Therefore the owners of slave admitted them to the family members and counted them as the remission category. Moreover, the owners of slave insisted their slaves to have the morality and thus remained considerably the repressive status.
