As a result of making a comparative study on the prohibition rule with Tang Dynasty of China, there are a lot of part of same purpose and some differences in quantity of penalty.
These show that in the early years, Koryo Dynasty´s prohibition rule hadn´t followed an exemple of Tang´s. So to speak, because in the early years of Koryo Dynasty, accounts of the enactment of the prohibition rule haven´t been found out in existing historical materials, it seems to us the Koryo´s prohibition rule inherited from the Silla Dynasty´s. Silla Dynasty adopted already the prohibition rule of the Tang and had developed it into the native one. On the other hand, the prohibition rule of the Tang hadn´t been legislated originally, but under influence of the preceding dynasties, the purposes are equivalant, and the contents and the quantity are difference between the Koryo and the tang.
As a result of the comparative study of the chronological statements on the <<History of Koryo Dynasty: 高麗史>> and <<Brief History of Koryo Dynasty; 高麗史節要>>, the prohibition rule hadn´t described the collected historical materials as it, but reorganized by the articles of the criminal code. Because of the editor´s limit of legal knowledge, the included articles of the prohibition had a large number of the unadaptable contents; disregarding the motives of enacting, describing the contents and the conviction in violation. It shows to us an restriction to understand applying the cases of the day. The description of the <<History of Koryo Dynasty>> and <<Brief History of Koryo Dynasty>> have more affluent contents and described the collected historical materials as it is, process and effect of the accidents, we have been able to watch for the cause of the more concrete application of the prohibition.
